    I saw Gamers nexus explaining this recently. They said that if if you’re able to hear what the other person is saying then fair game as they can’t reasonably expect privacy, but if they go into a room or car then you can’t use sensitive equipment to record them. Essentially use a mic with the sensitivity of a standard human ear

      True in a single party consent state, but its a felony to record conversations of others without their knowledge in a two (or all) party consent state.
